Designed to meet the needs of any licensed agent, this E&O Insurance policy protects you in transactions related to the services you are able to perform as a licensed real estate professional. Coverage also applies to services as a real estate assistant or transaction coordinator. For an additional premium in Groups 1 & 2, you can also be protected for the services you provide that relate to Property Management and Mortgage Brokering.
What else does Real Estate Agent & Broker E&O Insurance cover?
Beyond the more common claim scenarios, policies are written to address additional claims related to Lockbox, Megan’s Law, Fair Housing discrimination, security breach incidents, public relations crises, disciplinary actions, subpoenas, pollution (failure to disclose), and open house bodily injury and property damage. All services for which a real estate license is required, excluding any: mortgage brokering, property management, business brokering, syndications, development of property or exclusive listing agreements with a builder or developer.
The following services, only in relation to real estate: consulting/counseling/accredited standards review, expert witness testimony, notary services, short sale price negotiation, transaction coordination.
Optional for Groups 1 & 2: Property Management Insured Service:
Property Management where an executed written property management contract exists between the insured and property owner, containing express language requiring the property owner to indemnify, defend and hold harmless any of You for acts relating to services provided as a property manager or leasing agent; and express language detailing the scope of services to be provided under the property management agreement. Coverage does not extend to services provided by You that are legally required to be handled by the property owner or an attorney licensed in the state where property is located.
Optional for Groups 1 & 2: Mortgage Brokering Insured Service:
Brokering of mortgage loans secured by Residential Property and funded by a financial institution. Financial institution means a state or federal chartered bank, credit union, or savings and loan association. A financial institution is not a private party, individual or company that lends money from assets it owns or controls. This Insured Service includes loans funded via a warehouse line of credit if, prior to closing, the lender pre-approved and agreed to repurchase the loan within 30 days of closing.
